43rd Parallel, LLC, also known as: radi8er (“we”) respects the privacy of our App Users (“you” and “your”) and values your trust.

This Privacy Policy (the “Policy”) explains how we collect, use, disclose, and safeguard your Personal Information when you register at and/or access the radi8er platform, including any website, form, media channel, or mobile application related or connected thereto (collectively, the “Platform”).

Please read this Policy carefully. If you do not agree with the terms of the Policy, please do not access the Platform.

2 - CHANGES TO THIS PRIVACY POLICY

We reserve the right to make changes to the Policy at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of the Policy. Any changes or modifications will be effective immediately upon posting the updated Policy on the Platform. Electronic notification will be sent to your email as listed in your App User account; however, if your contact information is incorrect or non-existent then you waive the right to receive specific notice of each such change or modification.

You are encouraged to periodically review the Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Policy by your continued use of the Platform after the date such revised Policy is posted.

We may collect information about you in a variety of ways, such as when you register to create an App User account on the Platform, when you provide or modify materials and information in an existing account, or when you access the Platform.

We need your personal information in order to provide to you our services, answer questions you may have, keep track of activities happening with your account, provide customer support, contact you as needed, provide updates, and deliver a high quality experience.

You are under no obligation to provide us with personal information of any kind; however, your refusal to do so may prevent you from using certain features of the Platform.

The radi8er Platform needs your location (latitude & longitude) data in order to find nearby music and generate a song playlist.

Listening habits (in the form of song metrics & analytics).

Non-personal information you may choose to provide so we can enhance the radi8er Platform experience for you and provide additional radi8er features:

Music filtering and preferences (personas & favorite artists).
Social Media account information and name (if using Single-Sign-On feature).
Advertising ID:
- This is a unique, user-resettable ID for advertising, provided by Google. App Users can reset their identifier or opt-out of personalized ads within their App User settings.

3.4 - Derivative Data

Information our servers automatically collect when you access the Platform, for logging, analysis, and security purposes:

IP Address.
Browser type.
Browser cookies.
Device information.
Operating System.
Access date and time.
Clicks and interactions with the Platform.
Referring or exit pages and URLs.
Domain names used to access the Platform.

4 - USE OF YOUR INFORMATION

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Platform to:

Create and manage your account.
Provide Music Streaming services to the radi8er App Users.
Compile statistical data to report required metrics to Music Licensing organizations.
Compile anonymous statistical data for use internally and to be shared with you and other third parties.
Email you regarding your account.
Occasionally email you educational materials/guides and marketing information.
Occasionally offer you a voluntary questionnaire about current or possible future services.
Offer you opportunities for promotion on the Platform.
Prevent fraudulent transactions, monitor against theft, and protect against criminal activity.
Conform with legal requirements in response to a subpoena.
Resolve disputes and troubleshoot problems.

5 - DISCLOSURE OF YOUR INFORMATION

We may share information we have collected about you in certain situations. Your information may be disclosed as follows:

5.1 - By Law or to Protect Rights

If we believe the release of information about you is necessary to respond to a legitimate legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation. Only with your explicit “opt-in” consent, may we share your information with third parties that perform services for us, or for the benefit of artists, such as providing information to music venues to assist in making booking decisions, for promotion of artists in our library, or other such related purposes. If you wish to change your preference at any time, you may do so by logging into your App User account and updating your account settings.

5.6 - Business Partners

Only with your explicit “opt-in” consent, may we share your information with our business partners to offer you relevant products, services or promotions. If you wish to change your preference at any time, you may do so by logging into your App User account and updating your account settings.

5.7 - Business Reorganization or Acquisition

If we reorganize, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. You acknowledge that such transfers may occur and that the transferee may have a different Privacy Policy.

5.8 - Third-Party Websites

The Platform may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with us. Once you have used these links to leave the Platform, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Platform.

6 - SECURITY OF YOUR INFORMATION

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

Steps we have taken to secure your personal information:

We require Secure Sockets Layer (“SSL”) encryption to access the Platform.
We restrict employee access to databases containing personal information and impose confidentiality requirements upon employees who need to know such information.

7 - POLICY FOR CHILDREN

We do not knowingly solicit information from or market to children under the age of 13. If you become aware of any data we have collected from children under age 13, please contact us using the contact information provided below.

8 - CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. However, we will make reasonable efforts to restrict our collection of Derivative Data when this DNT feature is enabled.

9 - REVIEW OR CHANGE YOUR INFORMATION

You may at any time review or change your personal information on the Platform by logging into your App User account settings and updating your information, or by contacting us using the contact information provided below.

10 - DELETION OF INFORMATION

If you wish to remove personal information from the Platform, you must contact us using the contact information provided below to terminate your App User account.

You may request the removal of your personal information from the Platform at any time. You understand and agree, however, that we may retain any anonymous statistical data.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our logs, security platforms, or backups to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

11 - EMAILS AND COMMUNICATIONS

If you no longer wish to receive correspondence, emails, or other communications from us, you may opt-out by logging into your App User account and updating your preferences or contacting us using the contact information provided below.

12 - CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
